Tomorrow, i.e. Wednesday - 08/18, LE will be stepping up their patrols and cracking down on folks who do not use handsfree cellular devices when driving.

So, if you have a compelling need to be on your cell phone make sure you are using it in conjunction with a hands free device. If not, you run the risk of being ticketed. Fines may vary, but from what I gather, they are around $150.

Great post, BT. Good to know!

I was in traffic school a few months ago, where my instructor told us that being pulled over for cell phone usage without a hands free device, or text messaging while driving, was an automatic point on your record. And nope, you can't wipe it off your record with traffic school, either

Keep in mind, some of the heavier infractions, like Drunk Driving, is 2 points.

AND, if you have a self-mounted Tom Tom, or other navigational system, that didn't come fixed into the dash of your car, you must now, by law, mount it on either the driver or passenger side of the front windshield. You can be pulled over, and cited, if your navigational system is mounted on top of the dashboard, or in the middle of the windshield, just above the dashboard.

Why? Who the hell knows.

Not certain ...

But, I am speculating that the obstruction to the field of vision caused by mounting the TomTom elsewhere may be the rationale behind having the TomTom mounted on either the driver or passenger side of the windshield.

Makes no freaking sense ... But, a number of laws that have gone into effect fall into the same category, "non sense" .

I remember reading about this at the top of the year (they always have those "don't forget about the new laws" stories every new year.)

I was driving up from LA earlier this year, and while grabbing a cup of coffee, I asked a CHP officer about this.

He said the dashboard mounts are okay. It's the windshield mounts that are not okay, unless they're in the corners of the windshield. (I showed him my Garmin dash mount and he said that was fine.)

This may be an opinion that changes depending on how fresh the donuts are at Winchell's.

Bummer if you get caught, but no big deal. Pay the ticket, move on.

The real hazard, in my mind, is the extra 10-15 minutes that you'll be late for your FBSM appointment. The reason you were calling on your cellphone in the car was, after all, because you were already running late, right?

Spending precious time with a state trooper instead of your ATF? Now that's a waste!

I got caught on my handset last summer = $156 when it was all said and done.

And that's not counting the increase in my monthly car insurance bill.

Thanks for posting this! It's not very clear about using a handheld GPS while driving. Below are items from the CA DMV about hands free and windshield obstructions. Couldn't find anything about mounting on the center console.

Here's the law. I guess we are one of two dumb states that enacted a stupid law.

Windshield Mounting of GPS Legalized in California (But There's a Catch)

In late September, California Gov. Arnold Schwarzenegger signed into law Senate Bill 1567, the GPS Windshield Safety Act, which permits the mounting of portable GPS units in specific areas of vehicle windshields. Windshield mounting was previously illegal in California, and those who ignored the law were sometimes ticketed and fined $108 for "obstructed windshield" violations. California drivers take note: the new law does not take effect until January 1, 2009.

Kudos to the state legislature and the governor for lifting this ban and "decriminalizing" GPS. I've always contended that driving is safer with GPS.

The new law, however, has an odd clause that specifies the GPS must be mounted within "a 7-inch square area in the lower corner of the windshield farthest removed from the driver (the passenger side) or in a 5-inch square area in the lower corner of the windshield nearest to the driver (the lower left corner of the windshield)." That means the most common and useful front-and-center GPS windshield mount is still banned. Also, many standard GPS power cords are not long enough to reach from a power port, all the way to the lower corners of a windshield (not to mention the increased wire clutter created by these corner mounting locations).

Also, the passenger side mount is useless to the driver, and the lower left corner mount forces the driver to take eyes off the highway in an awkward way. I guess drivers can only hope that the police will ignore proper center mounts, or issue warnings, rather than tickets.

California was one of only two states (the other is New Jersey) banning windshield GPS mounting
