   All I can say, it ouch, ouch ouch. LG LE tried to sting legit Asian CMT, she said no to HE, they got her, and her husband, on a couple of minor infractions - working after hours at the request of vice cop, not covering his package 100 percent

Fisher: Woman's massage services were not appreciated in Los Gatos

The ad on Craigslist for massage services by "beautiful Asian girls" caught the attention of the Los Gatos vice cops. But while Amy Hu, a certified massage therapist at Relaxing Massage on North Santa Cruz Avenue, is indeed beautiful and Asian, when an undercover cop asked for a "happy ending" massage, she indignantly refused.

"I don't do that, I do massage only," says Hu, mortified that anyone would think the business she and her husband opened last year was a front for prostitution. "I'm a good girl."
A good girl and a good massage therapist, according to her clients. But not, apparently, a good enough businessperson to pass muster in Los Gatos.

While the police sting turned up no hanky-panky, it did uncover some code violations. On an April afternoon, the police burst into Relaxing Massage and hauled Hu's husband, David Jie, to jail while she and their 6-year-old daughter watched in horror. The town yanked their permit and now Hu and Jie face losing their business and their reputations.
"We thought Los Gatos was the perfect town," Hu, 36, told me Friday, her eyes filling with tears. "It was clean and nice and the people were friendly. I think they did not want us here."


Los Gatos may be clean and nice, but it's not a place to bend the rules -- at least not for Asian massage therapists. None has stayed open downtown more than a few months. Hu thinks it's because businesses
offering $59 massages aren't welcome in classy downtown Los Gatos, with its boutiques, home furnishings dealers and high-end day spas.

But Town Attorney Michael Martello says if the cops are particularly tough on massage parlors, it's because the industry is rife with prostitution and unlicensed operators.
"They are not like other businesses," he said. "When they are massaging and touching people, they are getting intimate with them -- not in biblical sense, of course -- people have a right to know who they are, that they aren't criminals."

I understand his concerns. Yet I think the cops may have gone overboard on this one.
Chinese immigrants Hu and Jie borrowed $40,000 to fix up their studio and signed a three-year lease. Their landlord, Joe Vieira, told me Hu was meticulous about getting the necessary permits and licenses from the town before opening in October. If she violated any laws, he believes it was out of ignorance. For example, it's illegal to put signs on the sidewalk, but lots of downtown businesses do it. Why was she the only one cited?
"I think she's getting a raw deal," he said.

According to police records, the provocative Craigslist ad, which Hu says a friend created for her, started it all. An undercover officer twice tried to catch Hu providing illegal favors, but she didn't take the bait. At one point, the cop reported, his genital area was left uncovered briefly, a code violation. During another, she had a therapist assisting her who didn't have a town permit.

Then he asked to come in for a massage after hours, claiming he was a chef who worked until 10. Hu says she reluctantly agreed, not wanting to disappoint her customer. She had no idea it was a setup.

Clearly Hu made mistakes. Martello says she made too many to forgive.
"If you say everything was a mistake, then you don't know how to run your business," he said.

But this business never posed a danger to the good citizens of Los Gatos. By closing it down, much more is lost than gained.

My problem with this is the craigslist ad; "Beautiful Asian Girls". Whether a "friend" placed the ad or not, who really cares if your CMT is beautiful or Asian? If you are there for a legit massage, these things don't matter.

Sorry there was a bust. I really am! But, I have to say it sounds like it was not a legit place. She didn't take the bait, good for her, no prostitution charge. But the police were pissed that she wouldn't and did whatever they can to make her life difficult.

This just doesn't seem that much out of the ordinary for a small town.

I agree that the copy may be why they were targeted, but beauty usually matters I'm afraid. I am very picky about CMTs.

   All CMTs in LG have to follow these procedures:

1. fill out this form

2. And do the following

Completing an Application
- Participating in a Background Check (Fingerprinting, Criminal History Check, and Photograph)
- Documenting Required Education (300 Hours)
- Providing a Copy of Insurance
- Paying Permit Fees
- Obtaining a Business License

I realize there is a bunch of subcontracting of space quietly going on in LG and other places by independent CMTs and hearts to get around the regs, but she was able to prove her 300 hour training and until the LG LE visited, didn't have any criminal background that prevented her from opening a place of business in LG

I think her "crime" was poor marketing. She should have compared her marketing to some of the upscale day spas in LG/Saratoga such as:

and should have advertised on massageanywhere.com or Groupon rather than CL, which is becoming, if it is not already, a free for all, like the underground...

   Saying "Beautiful" is now poor marketing? It seems like great marketing to me. This lady is an immigrant doing massages. I don't find the masseuse job as being luxurious. The work is hard. Why should she have to change just because illegal businesses use the word beautiful as well. Better not call your GF or Wife Beautiful then; you're calling her a whore.

Atrocious a good tax paying citizen was set up and destroyed so as to appeal to certain factions. Disgusting really is there no real crime in Los Gatos?

   Apparently not. Its disgusting. The amount of debt she took on to make the business work. She should be allowed to correct her code violations and get on with her work if she's legit. Very sad.

Agree with both of you Oshunshoney & Dunester... it's crazy. And if you look at the ads of the other Los Gatos Spas you can kinda see from where any "complaints" might have come.

I'd say yeah! It's just that...upscale posh and (I think it's safe to assume) white salons not wanting anyone else in town who could cut into their biz, muscling her out with bullshit "code violations" & innuendos enough to ruin her reputation for legal biz...

   White Gatos doesn't have its own crime so they need to make some up or import it. Surprisingly however they do have a black cop working the night shift. Can you imagine having a black man prowling through the bushes only to find out its a Los Gatos cop? Oh what a world.

   Its such a shame. I swear. I will never understand how it is legal for law enforcement of ANY kind...(FBI, Local, DEA..) to lie and trick people...deceive them to catch them for whatever reason..BUT...if someone did that to law enforcement in any way it is illegal and can be fined or arrested.

Such a sad story. They should just be fined and written up for the violations and let them go back to trying to make a legitimate life for themselves.
