"Avoid Tempur-Pedic at All Cost Fucking ROB"
 
   I purchased a mattress from Tempur-Pedic in July and it was the worst feeling - a customer that gives a company more than $2000.00 cash. I paid cash for a mattress and it was to be delivered to me on a Wednesday. Come to find out, the mattress was never in stock and they would tell me lie after lie. I finally had to go and get the mattress from the warehouse myself around 10 days later. I never received any apoligies, calls from the store or anything.

Once I received the mattress, I did not like the feel.
The company did not offer to refund my money.
It's basically a done deal.
Thanks to all you mother fuckers on RB that recommend the Tempur-pedic bed. You gals and guys are a bunch of mother fucker's!!!

They do NOT OFFER MONEY BACK!!
Once you buy it. You are stuck with the merchandise.
They will charge you $150 to exchange another mattress set.
If you read their contract, it states that once they make their deliver on time, you can not get your money back.

Now you're messing with a Son of a Bitch!

That does suck. I'm sorry.

But on the bright side, maybe somebody else will like the bed. You could advertise it on Craigslist and see what happens. Two grand is an awful lot to drop on a bed and maybe you could get $1500 or so for it since it's brand new.

I personally spent about 3 or 4 hours yesterday shopping for a new bed. Went with an incredibly patient and generous friend who encouraged me to take my time. I was totally exhausted at the end of the trip but also completely satisfied with the choice.

Maybe Craiglist or EBay can help you get most of the money back so you can find something you really like. Wish you the best...

But if they never "delivered" it...? Anyway, from the experience you relate, their TV commericals are most certainly misleading.

I also notice that everyone seems to be remarketing those now, even Brookstone.

i'm no lawyer, but it sounds like they didn't make their delivery on time. thus, that no money back clause is not valid in your case.

you can't let them off that easily. perhaps a trip to small claims court? or pay a lawyer $100 to write a letter and make a phone call? give them some kind of trouble

According to you, they did not fulfill this part of the
contract. You had to retrieve the bed yourself ten days
later as there was no prompt delivery.
May be a technicality, but it's enough to get you
out of the contract.
I'd push them on it and threaten to sue.

If you actually paid cash, court is your only angle. If you paid by credit card, you could go to them for a charge-back for breach of contract.

Don't know about you, but I charge $2,000 to go pick up something at a warehouse.

I agree! You should also check into a class action suit as there may be one...ya never know, a friend of mine was working out at a local gym somehow the set the guard on a machine malfunctioned and he fucked up his bicep really bad, totally ripped it up and went to check online and apparently the manufacture of the machine had like 4 other law suits against them for the same thing, faulty guard bar.

Also check CA consumer law. With a purchase that large, you may have three days or something like that to abborgate the contract, particuarly if they did not perform on the delivery side.

I'm no lawyer, but paid too many of them too much money, and I think I've learned that "threatening" to sue is totally useless. Disregarded by recipient of threat. In fact, may make the person dig in their heels further and have absolutely no communication from that point forward. Perhaps with consistant bugging of them in a polite fashion, one MAY get ahead...maybe...once in a while,,,,hey, it COULD happen LOL

The way I've had the "threat" rendered to me is that a court filing is prepared, sent registered mail to the evil doer, and included with that filing-to-be is a note saying it will be filed in ten days unless the situation is remedied. Of course, in this case that might involve $300-$500 to have a lawyer draw up the suit, less if you can get a student to do it. One not need be a lawyer to file, but if the suit looks silly, it will only make the bad guy laugh, and may give him ammo to claim your suit a "frivolous lawsuit" and get you to pay his court costs.

I don't know what small claims court max is, but that could be a route to go. Of course if they don't pay up in either case, extracting the money is a whole 'nother ball of wax... Nolo Press puts out a VERY good book about small claims court, written specifically for California laws:

Most furniture stores...especially those Asian owned places...appear to carry that Tempurpedic crap. You should have tried it out before buying it...especially with a mattress set.

I tried it and agree that it sucks...

Hey I love those beds, however they are too much $ so I got me a nice Sealy and that is the best bed I have been in since the tempur pedic that a regular of mine had. It was heaven but I paid 2400 for my bed and the frame and even that was a lot of $ for a bed - I just have to get a lot of use out of it

Don't get all bent out of shape at the RB gals & guys, you are the one that did not like it, I always try things out 1st - hell I spent damn near 50min in the store and tried 20 beds before I got the one I have...so get over it and sell it on CL or EBay like most people do!

I didn't want to put out that much money for a bed - but I do love my memory foam topper. $200 from Costco and I sleep like a baby. Besides, having springs underneath allow for more bouncing action, when needed.

I'm sorry you got ripped, but you do need to read the contract more closely and actually try out the bed before throwing down the cash. Sounds like you may have a case to get your cash back...hope it works out.

Someone who loves memory foam toppers and has them on all of her beds sent me one as a gift. She said you will sleep so well because it will eliminate pressure points. I tried it, but it made me keep waking up with my hips and lower back sore. I ended up putting it on a guest room bed that never gets used. I guess they are great for some people, but not all.

It could be worse. At least you finally got it.

In April I paid $1,200 for a small antique curio cabinet on Ebay. I had to hire someone to deliver it. A place in Maine that sells and delivers antiques said they would deliver it for $600, and it would take 30-60 days. I thought it was sort of expensive and a long time to wait, but paid them anyway. They picked it up from the seller in Illinois about two weeks later. After 60 days I called them and asked when I would be receiving it. They said you will get it in 2 weeks. Two weeks later I called again. Whenever I call, they just say you will be getting it later. It is September, 5 months later, and I still don't have it. Apparently it is in a warehouse in Utah. Finally I said look, refund my money and I will hire some other movers to bring it to me from there. They said no, they don't have anyone at that warehouse to release it. So the thing is sort of being held hostage, and there is nothing I can do about it. Well maybe I could drive to Utah and break into some warehouse to get it.

Yeah I hate when people BS like that - I had a company http://bootyfull.net/ totaly steal my money (about 300$) and the last email I got was something like "I will look into this" after getting 20emails stating that the package was "processing" and then "processed" and still after almost 2yrs - NADA!

   I got a tempurpedic from a dealer in Oakland for less than that, delivered.

I love the bed, the soft foam, it's a great pad for love making.

Got it delivered the next day.

Regret to hear of your problems.

It's a great bed, the company is going public and they are everywhere.
