   Why would the gal get cited?

The N.H. law:

645:2: Prostitution and Related Offenses
I. A person is guilty of a misdemeanor if the person:
(a) Solicits, agrees to perform, or engages in sexual contact as defined in RSA 632-A:1, IV or sexual penetration as defined in RSA 632-A:1, V, in return for consideration

Clearly she didn't engage in sexual contact, and it would be hard to demonstrate that she solicited or agreed to perform.

   True, but she may well have agreed to perform, and he may well have solicited, especially since he admitted to paying her for the agreed upon (though not actually performed) performance.

Yes, even here you can get busted for not having sex. Don't believe me? Ask an undercover if you can pay her for a date and you'll end up cited or worse.

   I think the keyword is "or" and not "and". I think just like California Law just agreeing to the act for money it a crime even if you don't carry it out.
