The attorney in question submitted her assertion in a special article in the Canada Free Press. Her argument states in part,

"Does anyone read the U.S. Constitution these days? American lawyers don’t read it. Federal Judge Susan R. Bolton apparently has never read it. Same goes for our illustrious Attorney General Eric Holder. But this lawyer has read it and she is going to show you something in Our Constitution which is as plain as the nose on your face.

"Article III, Sec. 2, clause 2 says:

"In all Cases affecting Ambassadors, other public Ministers and Consuls, and those in which a State shall be Party, the supreme Court shall have original Jurisdiction. In all the other Cases before mentioned, the supreme Court shall have appellate Jurisdiction."

In other words, the Judge in the Arizona case has absolutely no Constitutional jurisdiction over the matter upon which she ruled. As the Constitution makes abundantly clear, only the U.S. Supreme Court can issue rulings that involve a state.

This means that neither Judge Bolton nor the 9th Circuit Court of Appeals in San Francisco, to which the case is being appealed, have any legal standing whatsoever to rule on the issue.

Thus, U.S. Attorney-General Eric Holder filed the federal government's lawsuit against the state of Arizona in a court that has no authority to hear the case.

The attorney whose heads-up thinking concerning the Constitution provides the legal remedy for dealing with this blatant disregard for Constitutional law in the article at Canada Free Press, which can be accessed at the link above.

In a related development, another explosive discovery was made by those who actually take the Constitution seriously. The Constitution specifically allows an individual state to wage war against a neighboring country in the event of an invasion, should there be a dangerous delay or inaction on the part of the federal government. This information was cited by United Patriots of America.

From Article I, Section 10 of the U.S. Constitution, we find these words: "No State shall, without the Consent of Congress, engage in War, unless actually invaded, or in such imminent Danger as will not admit of delay."

No one who is actually familiar with the crisis at the southern border can deny that Arizona is endangered by the relentless assault of lawless Mexican invaders who ignore our laws, inundate our schools and medical facilities with unpaid bills, and even endanger the very lives of citizens with criminal drug cartels that engage in kidnapping, murder, human trafficking, and other mayhem, including aiming missile and grenade launchers directly at U.S. border cities from just across the Mexican border.

This is every bit as much of an invasion as the nation of Iran sending in a fleet of warships to the Port of Charleston.

The Constitution that forms the basis of the rule of law in this country says that Arizona has legal right to protect itself in the case of inaction or delay on the part of the federal government, including waging war in its self-defense.

This, when coupled with the clear Constitutional mandate that only the Supreme Court hear cases involving the states, should be ample legal basis for attorneys representing Arizona to go after the federal government with a vengeance.

Governor Jan Brewer and the stalwart members of the Arizona legislature have ample legal reason to stand firm against the illegal bullying of an arrogant, lawless federal government.

   Why is it that russians, italians, canadians, germans, saudis, lebanese, irish, french, east indian, chinese, japanese, korean etc all have to follow the rules yet none have any problems becoming americans and learning the english language, get visa's, and become nourishing and contributing members of the american populace, yet we allow the individuals from this singular country of mexico all the advantages of sneaking in, not paying taxes, not learning the language, and not becoming citizens?

Why does this one country feel they are above the rules of immigration to the usa?

My feelings have nothing to do with race, only that it seems one country above all others feels they can bend the rules and now all americans are made to feel bad for them?


As an eastern european american, I am very much aware of many family and friends who have come to america with the proper process and had no issues and become quite successful. Yet we are made to feel like we should allow this one country's citizens the right to use our USA as a stomping grounds without following any of the same rules my eastern european family members had to follow.


It is a bad example to show the other countries in the world. Especially when you look at the statistics of immigrants from other countries versus mexico when you focus on contributing members of each city or state.

   Also, as a previous citizen of arizona I will add that this is actually not a new law.

It was simply rewritten and had additions to the existing law from the 40's or earlier.


If it weren't for news coverage very few people might even care.

There are still current laws in arizona left over from the old west days that state you cannot leave the city of phoenix limits without a weapon for your own safety!

Maybe people should actually educate themselves on the ars codes and existing laws of an area before jumping on bandwagons built by media to spike their sweeps week ratings.

The only real change in arizona since this law is enacted is they are more likely to pull over certain profiles based on the statistic of those they suspect to be in usa illegally.

No one should be upset by this law at all unless they are doing something wrong. such as:


If you are swerving, you are profiled for dui and pulled over

If you are driving in an area known for street gals you might be pulled over if you pick up a hitch hiker

If you are driving without tags you will be pulled over

the problem with the az law is not the law, its the media attention and the response to it. Why is everyone so freaked out by an immigration law that most every country in the world has?


The only people who are actually angry about this are the people who are breaking this law, they are up in arms because they know they are breaking the law and they feel if there is enough public out cry they might change the law to conform to their continuing to break the law.

Sorry but i feel if they don't like getting pulled over and deported they can go through the same process my uncles and aunts went through to become real citizens, then they wouldn't care if they got pulled over or not cause they wouldn't have to worry that they were breaking the law anymore right?

Yes but what are the chances of any of the above having their immigration status check when stopped "legally"?
What proof of legality do you actually carry?


ALL have to follow the rules, even the Latin Americans. Or at least they are supposed to. My personal opinion is that it greatly increases the probability of being stopped for DWB (driving while brown). LE calls it "taillight, brakelight, licenselight, or swerving" from my personal experience. And until THAT starts happening to you and those around you, you have no idea how much it sucks.

Please do not state "if you're not doing anything wrong, you have nothing to worry about". I believe that there is something against unreasonable search and seizure, and to me simply being brown is unreasonable.

As for your Eastern European ancestors utilizing the proper process. . . I am sure that there are Native Americans that would differ. But that's another topic.

everyday is a good day, some days are just not quite as good as others.

   Mae has good point in pointing out the issues that may affect, and it is not fair that your life has to be affected by unwanted refugee's..

BUT profiling is so wrong and harmful to all of us...

Blacks have been profiling in their own country for century, which it has affected who they are and how they function in a white america...

No matter what their view or racisims are cops are more likely to pull black drivers, than any other nationality...

At the same time on how blacks decide to handle the unfortunate situation has to come to consideration...

Since you are mistreating me (the white man), blacks try to take the law in their own hand and try to trive in a criminal activities, which by doing so they are the one that have to pay for it and become enslave by white men...

Now by Arizona, we are trying to inflict the same painful and rasict behaviours to mostly Mexicans in Arizon...

So cops can go around and try to pick and harrass and brown skin mexicans if they feel like it...

This is not only the war of Latinos, it is the war of all minority in America, which we are the majority now...

Lets learn from history and not repeat the same hate to new groups of people...

If we must g deep, arizona and california did belong to mexico, if they have the balls as my people have fight to death and get their land back or recognize all mexicans as both mexican and american...

We all know america is goos at stealing things from other country...
